Supporters of Minnesota's proposed constitutional amendment that would require marriage to be between one man and one woman are suing over a change in the amendment's title.

Republican lawmakers and the Minnesotans for Marriage group discussed  the lawsuit this morning, saying that Secretary of State Mark Ritchie does not have the power to change the title of the amendment which will appear on the November ballot.

The wording of the amendment title, as approved by the Legislature, was:

"Recognition of marriage solely between one man and one woman."

Ritchie, though, has changed the title to:

"Limiting the status of marriage to opposite sex couples."

The lawsuit by amendment supporters say Ritchie unlawfully made the change and that Attorney General Lori Swanson approved it.

The Legislature has the power to put constitutional amendments on the ballot, but Ritchie maintains that because Gov. Mark Dayton had vetoed the legislation (but couldn't keep it off the ballot) that the title could be changed.
